SETTLEMENT RESOLUTION
CITY OF HAMTRAMCK
COUNTY OF WAYNE, MICHIGAN

At a special meeting of the City Council of the City of Hamtramck, County of Wayne, Michigan, held in said City on the 7th day of May, 2008, there were:

PRESENT: Ahmed, Algazali, Gordon, Klein, Stackpoole
ABSENT: Majewski, Shulgon

The following resolution was offered by Cathy Gordon and seconded by Catrina Stackpoole.

RESOLUTION 2008-45

SETTLEMENT OF DENNIS WHITTIE V CITY OF HAMTRAMCK, ET AL IN THE UNITED STATES DISTRICT COURT FOR THE EASTERN DISTRICT OF MICHIGAN, CASE NOS. 03-60219 AND 05-74887

WHEREAS, Dennis Gary Whittie (“Whittie”) was employed as a police officer by the City of Hamtramck through October 18, 2005;

WHEREAS, the terms and conditions of his employment were governed by a collective bargaining agreement between Whittie and the City of Hamtramck;

WHEREAS, a dispute has arisen between Whittie and the City of Hamtramck concerning his employment and discipline during employment, which has resulted in Whittie’s filing of two (2) complaints in the United States District Court for the Eastern District of Michigan, Case Nos. 03-60219 and 05-74887;

WHEREAS, Whittie and the City of Hamtramck agreed to an independent facilitation in an attempt to resolve this matter;

WHEREAS, the representatives of the City of Hamtramck at the facilitation arrived at a settlement of this matter which they have recommended to the Council for approval;

NOW, THEREFORE, IT IS HEREBY RESOLVED, that the City Council of the City of Hamtramck approves the settlement of this matter as set forth in the Independent Facilitation/Facilitative Mediation agreement of May 1, 2008.

IT IS FURTHER RESOLVED, that the City of Hamtramck’s acceptance of the facilitator’s recommendation is contingent upon successful negotiation of the Confidential Settlement Agreement and Release of All Claims being negotiated by the City of Hamtramck’s Special Counsel and execution by Whittie;

IT IS FURTHER RESOLVED, that the City Manager for the City of Hamtramck is hereby authorized to execute said Confidential Settlement Agreement and Release of All Claims on behalf of the City.
