SECTION I: PUBLIC HEARINGS - None

SECTION II: UNFINISHED BUSINESS--Ordinances scheduled for second reading and ordinances or resolutions previously postponed.

1. AN ORDINANCE PROVIDING FOR PAYMENT IN LIEU OF TAXES This ordinance provides for a service charge in lieu of taxes for dwelling units for low income persons pursuant to the provisions of the State Housing Development Authority Act of 1966.

The following items will be adopted on a single motion without discussion unless a councilmember requests separate consideration.

a. Letter from Mayor Majewski renewing Hamtramck Housing Commission appointment of Mr. Isaac Reeves.
b. Mayoral appointment of Melissa Trustman to the Economic Development Corporation and the Brownfield Redevelopment Authority.
c. Letter from Robert Zwolak requesting the resignation of councilmember Klein as mayor pro-tem.

5. RESOLUTION AUTHORIZING THE EXECUTION OF AN AGREEMENT WITH SUNSET EXCAVATING FOR HAULING OF DIRT AND SPOILS Bids were received to haul away dirt and spoils as a part of the Grand Haven project and Sunset Excavating was the low bidder at $15.50/yard. $40,000 is requested for this service which was anticipated and budgeted.

SECTION IV: NEW BUSINESS--Ordinance introductions and resolutions for initial consideration.

1. RESOLUTION AMENDING THE CITY OF HAMTRAMCK 2007-08 BUDGET ON JUNE 30, 2008. On May 22, 2007 the Hamtramck city council adopted a budget for the 2007-08 fiscal year. Since the adoption of the budget, the city has experienced events which have impacted both revenue and expenditures, leading the finance director to recommend changes to the budget for the fiscal year ending June 30, 2008.

2. RESOLUTION AMENDING THE DEVELOPMENT AGREEMENT BETWEEN THE CITY OF HAMTRAMCK AND CAMPAU PLACE LLC

Shortly after the agenda went out, Scott Klein sent the following message:

Dear Honorable Council, Mr. Manager and Department Heads,

As you are aware, the mayor has left the city for a brief, well deserved vacation. As I began planning to chair the upcoming meeting on July 22, I was informed by several council members that they would not be available to attending this meeting.

Therefore, as acting mayor of the city of Hamtramck and under the powers conferred upon my office by local and state law, I am canceling the meeting of Tuesday, July 22 for lack of quorum. This advance cancellation is being
made to minimize the disruptions in the life and schedules of our department heads, our residents, and fellow council members.

I ask that all agenda items currently before us be moved to the next agenda. If a matter of great urgency arises, I will work diligently to schedule a meeting where everyone may attend to address the situation--as unlikely as that may be.

Thank you for your understanding.

I have been told that at least two council members will be present Tuesday to listen to the public despite the meeting being cancelled.

In case anyone else was wondering, here is the resolution to amend the development agreement on Shoppers World:

RESOLUTION 2008-

RESOLUTION TO AMEND THE DEVELOPMENT AGREEMENT BETWEEN THE CITY OF HAMTRAMCK AND CAMPAU PLACE, LLC FOR 9800 & 9808 JOSEPH CAMPAU

WHEREAS, the City of Hamtramck is a party to a Development Agreement with Campau Place, LLC (Developer) for property located at 9800 & 9808 Joseph Campau;

WHEREAS, the Development Agreement states that the Developer will make a payment in lieu of taxes (PILOT) for the residential portion of the development project;

WHEREAS, the Development Agreement must be amended to conform with the Area Wide PILOT Ordinance approved by the Hamtramck City Council; and

WHEREAS, the City and the Developer wish to amend the Development Agreement to be consistent with the City’s ordinances.

NOW THEREFORE BE IT RESOLVED by the city council of the City of Hamtramck, Wayne County, Michigan that:

FIRST: Section 3, Part C of the Development Agreement shall be amended to require the Developer to make a payment in lieu of taxes (PILOT) in an amount equal to Four (4%) Percent of the difference between the Annual Shelter Rent actually collected and the cost of utilities;

SECOND: Beginning in 2010, the Developer shall pay to the City an annual General Administrative Fee in the amount of Six Thousand Five Hundred ($6,500.00) Dollars, which will increase Three Hundred ($300.00) Dollars each year. The General Administrative Fee shall remain in effect for as long as the Developer is required to make payments in lieu of taxes.

Anybody have a clue what the Annual Shelter Rent and cost of utilities might be? What the will the actual financial difference be for this amendment?

If all of the apartments were rented shelter rent would be $500 x 12 x 54=$324,000. I asked at the meeting at the library and was told by the developer that the tenants would be responsible for their own utilities. Therefore according to law they cannot deduct the utilities that the tenants pay. So it would appear to be that the pilot would be at the most $12,960 per year and that is all of the apartments are rented every month. Hope this helps

Two big meetings last night. Unfortunately I was not able to attend either. :( Stupid work.

Anyone have feedback or comments about either the town hall meeting or the flood lawsuit meeting?

Thanks, Donna. $12,960 + $6500 administration = $19,460, or about $540 per year less than was previously agreed to, and $360.37 per apartment per year. That's a pittance compared to what the average rental property in Hamtramck pays.

Mike: I was not able to attend either meeting either, and have not heard about the flood meeting.

As to the council meeting, I heard that there were over 100 people there. It was not televised. The only council people in attendance were Cathie Gordon and Abdul Algazali, though the city attorney was also present. People spoke primarily about the flooding and the rights ordinance. I heard that the primary complaint about the rights ordinance was that it was passed in an underhanded way and promoted in the media falsely. There were also complaints about the council rules, and the way public comments are restricted at the opening of the meeting. I heard it was a good meeting.

It wasn't an official council meeting, right? That was cancelled weeks ago if I'm not mistaken. From what I heard, Gordon and Alagazi decided to hold an open town hall.

Oooo... I'll have to watch those, though, I can see that the editing will disappoint me. The person who posted it is claiming that it was an anti-gay town hall meeting, when it was in reality a committee meeting of city council during their regular meeting time. Solidarity has a habit of canceling meetings in advance when they know they won't have a majority on the board.
